Medical Negligence

Have I suffered from medical negligence?

Medical negligence is an unfortunate reality in both NHS and private healthcare and can lead to serious consequences such as unexpected health complications, disability, or even fatalities. If you’ve experienced any of these outcomes while under medical supervision, it’s possible you could be entitled to medical negligence compensation.

Understanding and navigating medical negligence claims can be complex. That’s why our expert team of medical negligence specialists is available to provide free, no-obligation advice. We’re dedicated to helping you make sense of your experiences, clarifying your legal options, and assisting in determining if you qualify for compensation.

Here are some common types of medical negligence that often result in claims:

Surgical Errors

Surgical errors are regrettable occurrences in medical procedures that can have severe consequences. This could include instances such as incorrect surgical procedures, operating on the wrong body part or leaving a foreign object inside the patient. These mistakes can lead to unnecessary pain, extended recovery times, or even create new health problems.

Misdiagnosis or Delayed Diagnosis

A crucial part of medical treatment is an accurate and timely diagnosis. Misdiagnosis, or diagnosing the patient with the wrong condition, or delayed diagnosis, which refers to unnecessary delays in diagnosing a condition, can lead to ineffective treatment or worsening of the patient’s condition.

Death

Tragically, in some cases, medical negligence can lead to the death of a patient. This could be due to various reasons such as severe surgical errors, incorrect medication, or failure to adequately monitor a patient’s condition.

Birth Injuries & Cerebral Palsy

Medical negligence during childbirth can result in severe birth injuries, including cerebral palsy. These can be the result of improper use of medical equipment, failure to adequately monitor the health of the mother and baby, or mistakes during delivery.

Gall Bladder Surgery Errors

Complications from gall bladder surgery can arise from surgical errors like damaging nearby organs, improper post-surgical care, or failure to manage surgical complications. These errors can lead to severe abdominal pain, infection, and other serious conditions.

GP Negligence

General Practitioner (GP) negligence can occur when a GP fails to correctly diagnose an illness, prescribes incorrect medication, or does not refer a patient to a specialist when needed. This can result in the patient’s condition worsening.

Vaginal Mesh Complications

The use of vaginal mesh in surgical procedures can sometimes lead to serious complications, including infection, organ perforation and chronic pain. Negligence in these cases could be due to improper implantation, use of defective mesh, or lack of informed consent.

Sepsis

Sepsis is a severe, body-wide response to an infection which can lead to organ failure and death if not promptly diagnosed and treated. Negligence can occur if there’s a failure to diagnose or treat sepsis promptly, or failure to manage an infection which leads to sepsis.

Medication Errors

Medication errors such as prescribing or administrating the wrong medication, incorrect dosage, or failure to recognise harmful drug interactions can result in worsening of the patient’s condition or the development of new health problems.

Dental Negligence

Dental negligence can result in serious harm including nerve damage, inappropriate tooth extraction, or misdiagnosis of dental conditions. The consequences can be physical, like unnecessary pain or loss of teeth, and psychological, such as loss of self-confidence.

Any Injury Sustained during Treatment

Any harm or injury sustained during treatment which could have been avoided with proper care could potentially be a case of medical negligence. This can include falls, pressure sores, or injuries from improperly performed procedures. If you are unsure, contact our team today. We can quickly tell you if you have a potential claim for free without any obligation.

Can I claim compensation from the NHS?

In short, yes you can, but time limits apply so act now. If it can be proven that you have suffered hospital negligence, or any other form of clinical malpractice you can make a medical negligence compensation claim.

To make a claim, you will need to instruct a medical claims solicitor. If your claim is against the NHS in Scotland, your lawyer will need to operate under Scottish Law.

Our team of Scottish clinical negligence solicitors offer free advice about your claim and can represent you on a no win, no fee basis should you wish to proceed.

What time limits apply to a medical malpractice claim?

Generally, if you are over the age of 18, you have 3 years from either the date of the negligent act or the date of knowledge of the negligent act to make a claim for medical negligence. There are circumstances that would allow for the 3 year limit to be increased, but these are few and far between and should not be relied upon.

If you believe that you or a family member have suffered as a result of clinical negligence and wish to claim compensation, it is vital that you contact a lawyer within the 3 year time limit. Whilst different timescales apply for those under the age of 18, it is always advisable that you speak to a specialist lawyer as soon as possible.

If you are outside of the 3 year limit, it is still sensible to contact our medical negligence specialists, as circumstances outside of your control may still allow a claim to be made. We can advise you of these circumstances without cost or obligation.
